What is whiplash?
Whiplash is most commonly associated with car accidents, with the force of impact causing the victim’s neck to jerk and ‘whip’ with such ferocity that it causes injury. The full extent of this injury can manifest itself in multiple ways:
- Neck pain
- Lower back pain
- Pain in other limbs
- Muscle spasms
- Ringing in the ears
- Swelling and numbness
These symptoms can vary from person to person depending on the specifics of the accident, and this is also true of the time it can take to notice the real effects. In most cases it can take up to 12 hours or more before the victim can start to feel discomfort. Depending on how the injury has affected your ability to go about your everyday life, you might be able to claim for multiple damages.
How much could I claim?
While it is difficult to give each claimant a definitive figure of how much they could claim before knowing the full particulars of their accident, there are guideline amounts which judges use to decide how much compensation to award. However, these figures don’t take into account special damages for out-of-pocket expenses e.g. Travel expenses, loss of earnings, bonuses, household costs, medical treatment, special care etc.
The following figures are a snippet taken from the twelfth edition of the Judicial College Guidelines for the Assessment of General Damages in Personal Injury Cases and could be conservative if you have extra losses to add-on top of this:
Severe Neck Injury (I, II & III) – £36,740 to around £119,900
Injuries such as fractures or dislocations, or serious soft tissue damage and or/ ruptured tendons which lead to permanent disability. As well as injuries including incomplete paraplegia, permanent spastic quadriparesis, limitation of movement and/or severe headaches.
Moderate Neck Injury (I, II & III) – £6,380 to £31,130
Soft tissue or wrenching-type injuries, or severe disc lesions resulting in cervical spondylosis, limitation of movement, permanent or intermittent pain, stiffness or discomfort. Fractures or dislocations causing immediate symptoms and which may require spinal fusion.
Minor Neck Injury (I, II & III) Up to £1,705 – £6,380
